Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a binding agreement between you ("User") and Cikos ("we", "us"). By registering on the platform, creating an account, or using the services, you declare that you have read, understood, and fully accepted these Terms, the Privacy Policy, and the Risk Disclosure Statement.
If you do not accept any of these documents, you may not use the platform. We reserve the right to modify these Terms at any time. Material changes will be communicated via email and/or in-app notification and will require new explicit acceptance to continue using the service.
2. Service Description
Cikos is a Software-as-a-Service platform that assists users in analyzing and operating in cryptocurrency futures markets through:
- Trading signal generation based on proprietary rules and AI analysis
- Integration with third-party exchanges (Binance, Bitget) via user-provided API keys
- Automated order execution in "paper trading" or "live trading" mode at the user's discretion
- Risk management based on configurable rules (max drawdown, size limits, kill switch)
- Reporting, backtesting, and analytics tools
3. Eligibility
To use Cikos you must:
- Be at least 18 years old and legally capable of entering into contracts
- Not be a resident or citizen of jurisdictions subject to international sanctions
- Not have been previously suspended or banned from the platform
- Provide accurate information during registration and keep it updated
- Understand the risks of cryptocurrency futures trading (see Risk Disclosure)
The platform is currently in private invite-only beta. Access is subject to possessing a valid invite code or to approval of a request.
4. Account and Security
You are responsible for the security of your credentials. You agree to:
- Use a strong password (minimum 12 characters, mix of upper, lower, digits)
- Enable two-factor authentication (2FA) before enabling live operations
- Notify us promptly of any unauthorized access to your account
- Not share your credentials with third parties
The exchange API keys you provide are encrypted at rest with industry-standard algorithms (AES-256-GCM). We strongly recommend creating API keys with trading permissions only and no withdrawal permissions, and applying IP whitelisting where possible.
5. Fees and Payments
Cikos offers pricing plans published on cikos.com. Prices are in EUR and subject to VAT per applicable regulations.
Payments are processed via third-party providers (e.g., Stripe). By using paid services you also agree to the payment provider's terms.
Subscriptions auto-renew at the end of each period. You can cancel anytime; cancellation is effective at the end of the current billing period. No partial refunds are issued for already-billed periods, except where required by applicable consumer law (e.g., EU 14-day right of withdrawal for consumer users under Directive 2011/83/EU).
6. Refund Policy
Cikos is a subscription service. This section supplements section 5 and specifically governs refunds.
6.1 Right of withdrawal (EU consumers)
If you are a consumer residing in the European Union, under articles 52–58 of the Italian Consumer Code (Legislative Decree 206/2005) you have the right to withdraw from the contract within 14 days from subscription, without giving any reason. To exercise this right, write to support@cikos.com stating your registered email and subscription date. The full refund will be processed to the same payment method within 14 days of receiving the request.
Exception: under article 59 letter o) of the Italian Consumer Code, the right of withdrawal lapses if the user has significantly used the service within the 14-day period (e.g. activated and operated at least one live trading session). In that case, clauses 6.2 and 6.3 apply.
6.2 Subscription cancellation
You can cancel your subscription at any time from the billing portal
(Stripe Customer Portal) accessible from /app#config.
Cancellation is effective at the end of the current billing period:
no pro-rata refunds are issued for the period already
billed and not yet consumed, except as provided in section 6.1.
6.3 Discretionary refunds
Outside the cases under section 6.1, we may grant refunds at our discretion on a case-by-case basis, particularly when:
- documented service malfunction that prevented usage for the majority of the billing period;
- duplicate charge or billing error;
- verified fraud (e.g. compromised account, unauthorized transaction).
Requests must be sent to support@cikos.com with evidence of the incident. We commit to responding within 7 business days.
6.4 Refund method
All refunds are credited to the original payment method used for subscription. Crediting times depend on your card issuer or account institution and are typically 5–10 business days. Once the refund is processed, you will receive a confirmation email at your registered address.
6.5 Unrecognized refunds
If you receive a refund notification that you do not recognize or did not request, contact us immediately at support@cikos.com for anti-fraud verification.
6.6 Chargebacks and disputes
If you dispute a Cikos charge directly with your bank or card issuer (chargeback) without first contacting us, we reserve the right to immediately suspend the account until the dispute is resolved. We encourage you to contact support@cikos.com first: in most cases we can resolve the issue directly and without additional costs for any party.
7. Permitted Use and Prohibitions
You agree not to:
- Use the service for illegal activities, including fraud, money laundering, terrorism financing
- Reverse engineer, decompile, or extract source code
- Use bots, scraping, or programmatic access beyond official APIs
- Overload our systems or generate anomalous traffic
- Attempt to access other users' data or bypass security controls
- Use the service to manipulate markets (pump and dump, wash trading, spoofing)
Violations may result in immediate suspension or termination at our discretion, without refunds. For illegal activities, we reserve the right to cooperate with competent authorities.
8. Intellectual Property
The Cikos platform, software, signal generation algorithms, interface design, logos, and content are owned by us or our licensors and protected by intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the service in accordance with these Terms.
User-generated data (configurations, watchlists, execution logs) remains the User's property. However, you grant us a non-exclusive license to process such data to provide the service, improve it, and comply with legal obligations.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The service is provided "as is" and "as available" without express or implied warranties
- We do not guarantee that generated signals will be profitable, accurate, or timely
- We are not liable for losses arising from your trading decisions
- We are not liable for third-party exchange downtime, network delays, or technical issues beyond our control
- Our maximum aggregate liability to you, for any cause, will not exceed the amount you paid in the preceding 12 months
The above limitations do not apply in cases of willful misconduct, gross negligence, or violation of non-waivable rights under applicable law.
10. Suspension and Termination
You may terminate your account at any time via the "Privacy" tab of the dashboard ("Delete account" function). Termination entails:
- Anonymization of personal data (GDPR art. 17)
- Revocation of all active sessions
- Removal of encrypted API keys
- Retention of anonymized aggregate data for legal/accounting obligations
We reserve the right to suspend or terminate your account if:
- You violate these Terms or related documents
- There are signs of fraud, market manipulation, or illegal activity
- You are inactive for more than 24 consecutive months
- We are required to do so by law or competent authorities
11. Governing Law and Jurisdiction
These Terms are governed by Italian law. For disputes with consumer users, the competent court is that of the consumer's residence under EU consumer law. For business users, the Court of Milan has exclusive jurisdiction.
Before resorting to legal action, the parties agree to attempt an amicable resolution through mediation before a registered mediation body.
Consumers may also use the European ODR platform for out-of-court online dispute resolution.
